60-year-old smuggler sentenced to 2 years in prison after failure to pay Shs52 million.

A 60-year-old man from Iganga Town Council eastern Uganda, who was hired by a rich man to smuggle uncustomed super match cigarettes for him,  has been sent back to Luzira prison to serve two years after failing to pay a court fine of Shs52 million.

Buyinza Swaibu who was the driver of the Fuso Truck that carried 540 cartons of the said Cigarettes from South Sudan, amounting to Shs104 million, had together with the owner of the goods Emolot Paul Sande and a turnboy Muyanja Joshua appealed the Chief Magistrate court sentence, before the High court’s Anticortuption Division.

However today, presiding Judge Lawrence Gidudu dismissed the appeal for lack of merit and upheld the orders of the lower court.

He noted that the appellants were properly found guilty of the crime because they didn’t have export documents from South Sudan, allowing them to bring the goods into Uganda, and decided to conceal the good in empty crates of beer, which showed that they had an intention to evade taxes.

What bothered the Judge is the conduct of the rich man Emolot to have used Buyinza to drive his smuggled goods and when it reached in paying the Court fine, he has only paid his and left the old man to rot in jail.

Apart from Buyinza who failed to get the money, the rich man and the 27year old turnboy are out after paying the fine.

They committed the offence on 7th/August/2011 at Mucwini in Lamwo District.

Around 1000 Ugandan couples to wed afresh.

Government has asked couples who conducted their marriages in the Pentecostal Church of Resurrection Bugolobi, Kampala, to go and conduct fresh marriages because there is no remedy that can be done to save them from their current plight.

Deputy attorney general Mwesigwa Rukutana says that there is no remedial action apart from the couples to repeat these marriages.

Rukutana says that these marriages should necessarily not be conducted in religious institutions but before registrar of marriages. Let them comply, it is simple, they just go announce their intention to get married it is pinned on notice boards.

Rukutana was responding to a matter of national importance raised by Mukono municipality legislator Hon Betty Nambooze Bakireke in which she informed parliament that dozens of these couples that are affected by illegal marriages from Bugolobi happen to come from her constituency and says that it’s not tenable to many people that a marriage conducted in a church can be nullified because the church’s registration hadn’t been gazetted.

Nambooze also wanted to know where government institutions to guide Ugandans on the matter were and asked if there is no remedy that can be given to these couples and that they aren’t required to undergo the same ceremony.

Around 1000 couples who wedded between 2006 and 2016 at the said church are facing the dilemma of their marriages being illegal as the church at time had not been gazetted to conduct marriages.
